1. Acceptance of Terms
By accessing or using the Ringse platform and services (the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Ringse provides an AI-powered call answering and voice assistant platform designed to help businesses handle inbound phone calls. The Service includes, but is not limited to: automated call answering with natural AI speech, call transcription and summarisation, call routing and forwarding, notification and alert services, call analytics and reporting, and dashboard access for managing call settings.
3. Account Registration
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.
4. Subscription and Billing
Ringse offers various subscription plans with different features and call limits. By selecting a subscription plan, you agree to pay the applicable fees. Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in these Terms or as required by applicable law. We reserve the right to change our pricing with 30 days notice.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Engage in fraudulent, deceptive, or misleading activities
- Harass, abuse, or harm another person or entity
- Transmit spam, chain letters, or unsolicited communications
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorised access to the Service or its related systems
- Use the Service for any illegal call recording without proper consent
- Resell or redistribute the Service without our prior written consent
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Ringse and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
7. User Content
You retain ownership of any content you provide to the Service, including custom call scripts, greetings, and business information ("User Content"). By providing User Content, you grant Ringse a non-exclusive, worldwide, royalty-free licence to use, process, and store your User Content solely for the purpose of providing and improving the Service.
8. Call Recording and Compliance
You are solely responsible for ensuring that your use of the Service complies with all applicable laws regarding call recording, consent, and disclosure in your jurisdiction and the jurisdiction of your callers. Ringse provides tools to help you comply with recording consent requirements, but it is your responsibility to configure and use them appropriately.
9. Service Availability and SLA
We strive to maintain 99.9% uptime for the Service. However, we do not guarantee that the Service will be uninterrupted, timely, secure, or error-free. We may perform scheduled maintenance with advance notice. Enterprise plan customers may have specific Service Level Agreements with additional guarantees.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Ringse shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from your access to or use of the Service. In no event shall our total liability exceed the amount you have paid to Ringse in the twelve (12) months preceding the claim.
11. Indemnification
You agree to indemnify, defend, and hold harmless Ringse and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.
12. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time through your account settings or by contacting us. All provisions of these Terms which by their nature should survive termination shall survive.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the new Terms.
